Return, Cancellation & Refund Policy — Ideas Decor Shop

This legally binding Return, Cancellation & Refund Policy ("Policy") governs all purchase contracts initiated through Ideas Decor Shop. By placing an order, the Customer ("You") explicitly accepts the terms, conditions, exclusions, and legal limitations set forth below.

⚖️ 1. Statutory Rights & Legal Framework

Nothing within this Policy seeks to exclude, restrict, or modify any mandatory statutory rights guaranteed to consumers under applicable local legislation, including the United Kingdom Consumer Rights Act 2015 and the European Union Consumer Rights Directive (2011/83/EU). Any provisions found to be unenforceable under local mandatory consumer laws shall be severed without affecting the validity of the remaining legal clauses.

🔬 2. Material Disclosures: Handmade & Technical Manufacturing Variance

Ideas Decor Shop operates as an industrial-artisan handmade manufacturing studio. Products, specifically engineering-grade silicone molds, are cast in small production batches or manufactured on a made-to-order basis.

The Customer acknowledges and legally accepts that industrial silicone castings are subject to minor structural anomalies. The following technical variances do not constitute a legal defect, lack of conformity, or misdescription:

  • Minor surface micro-bubbles or cosmetic imperfections on non-working/external faces of the mold.

  • Slight color hue deviations due to minor chemical catalyst or pigment batch variations.

  • Dimensional variances within a standard tolerance margin of ±2mm due to material shrinkage during curing.

If the mold strictly retains its physical structural integrity and functions perfectly for its intended casting purpose, it shall be legally deemed conforming to the purchase contract.

⏱️ 3. UK & EU Statutory Right of Withdrawal (14-Day Cooling-Off Period)

Pursuant to the UK Consumer Contracts Regulations 2013 and EU Consumer Rights Directive, consumers residing within the UK or European Union possess a legal right to withdraw from distance contracts within fourteen (14) calendar days without stating cause, subject to the exclusions detailed in Section 4.

  • Temporal Limitation: The 14-day withdrawal period expires precisely 14 days from the date the Customer (or a designated third party other than the carrier) takes physical possession of the goods.

  • Method of Notification: To execute the right of withdrawal, the Customer must provide an unequivocal, explicit written declaration of cancellation to info@ideasdecor.shop prior to the expiration of the deadline. Verbal or social media cancellations are legally void.

  • Restitution of Goods: Following valid notification, the Customer must dispatch the items back to the verified merchant depot without undue delay and strictly within 14 calendar days. The Customer bears the exclusive burden of proof and all direct financial costs for return shipping and tracking.

🚫 4. Absolute Legal Exclusions from Cancellation & Returns

In strict accordance with Article 16(c) of the EU Consumer Rights Directive and UK Regulation 28(1)(b), the statutory right of withdrawal and change-of-mind returns are legally null and void for the following product categories:

  • Bespoke / Made-to-Order / Custom Configurations: Any silicone molds manufactured, cast, or dimensionalized according to individual customer choices, bespoke sizes, specific text/logos, customized design parameters, unique master model configurations, or non-standard color choices.

  • Used or Chemically Contaminated Goods: Any silicone molds that have come into direct contact with casting agents, including but not limited to epoxy resin, polyurethane, Jesmonite, cement, plaster, pigments, or wax. Once a mold has been used or tested, it is legally classified as contaminated and unresaleable due to industrial safety and structural integrity risks.

  • Digital Assets: Virtual 3D model files (.STL) or proprietary digital designs, once data transmission, download, or email delivery has been initiated.

🌐 5. Change-of-Mind Policy (International Jurisdictions)

For all Customers residing outside the sovereign territories of the United Kingdom and the European Union (including North America, Asia, and Oceania), all sales are final. No returns, exchanges, or voluntary cancellations are permitted for a change of mind, procurement of an incorrect product size, or subjective variations in color expectation.

📸 6. Non-Conformity, Transit Damage, and Fault Claims

In the event that an item is delivered damaged in transit, or is legally verified to contain a structural manufacturing defect rendering it unfit for use, the Customer must submit a formal dispute to info@ideasdecor.shop within three (3) business days of delivery receipt.

Claims will not be adjudicated without the following digital evidentiary support:

  1. Your order number.

  2. Clear, high-resolution photographs illustrating the precise structural defect.

  3. Comprehensive photographs of the outer shipping box illustrating any physical impact marks.

  4. Photographs of internal protective packaging materials.

  5. A legible photograph of the original shipping courier label affixed to the parcel.

Upon verification of legitimate non-conformity, Ideas Decor Shop will satisfy its statutory obligations by providing a free replacement or a full refund, including standard delivery costs.

🧼 7. Legal Standards for Acceptable Returns

To qualify for any legal refund under Section 3, returned physical merchandise must arrive at our studio meeting strict evidentiary criteria. The items must be completely unused, pristine, entirely free of dust, debris, or chemicals, and securely sealed within their original commercial packaging.

Ideas Decor Shop reserves the statutory right under UK and EU law to deduct a percentage from the final refund amount up to 100% if the value of the returned goods has been diminished due to handling or repackaging beyond what was strictly necessary to inspect the item's physical characteristics.

🛃 8. Logistics, Refused Deliveries, and International Customs Liability

The Customer retains sole, unshared legal and financial responsibility for all local import VAT, Goods and Services Tax (GST), customs duties, clearing tariffs, and processing fees applied by the destination country's authorities.

If a parcel is returned to our studio due to a Customer's refusal to pay local customs duties, failure to clear customs, or failure to collect the parcel from a local depot:

  • All outbound shipping charges paid at checkout are completely non-refundable.

  • All return-freight transport fees, border processing charges, and courier penalties billed to Ideas Decor Shop will be deducted directly from any residual item refund.

  • If customs authorities confiscate, abandon, or destroy the parcel due to non-payment of import taxes, the Customer is entitled to zero (0%) refund.

🔍 9. Carrier Delays and Lost Consignments

Estimated transit times provided during checkout are strictly logistical projections and do not constitute contractually guaranteed delivery dates. Ideas Decor Shop is legally exempt from liability for delays resulting from Force Majeure events, customs inspections, border backlogs, or localized postal strikes.

No consignment shall be legally declared "Lost in Transit" until the courier's official investigative window has formally concluded. The mandatory minimum non-delivery wait periods are:

  • United Kingdom Domestic Shipments: 15 clear working days from the date of dispatch.

  • International Shipments: 30 clear working days from the date of dispatch.

Prior to any refund or replacement issuance for non-delivery, the Customer must execute and submit a signed legal Lost Post Declaration Form. Providing false data on this form constitutes mail fraud and will be reported to relevant authorities.

⚠️ 10. Product Use & Professional Liability Disclaimer

Silicone molds supplied by Ideas Decor Shop are engineered exclusively for industrial, craft, artisan, and hobbyist casting applications utilizing approved synthetic mediums (e.g., epoxy resin, gypsum, concrete).

Unless a specific product listing explicitly carries certified documentation stating otherwise, all products are strictly NON-FOOD SAFE, non-medical grade, and non-cosmetic safe. Ideas Decor Shop excludes all liability for any bodily harm, chemical reactions, property damage, or commercial financial losses resulting from the unauthorized, improper, or negligent application of its products.
